Prince Harry’s US visa woes could be helped by President Joe Biden winning the election later this year, an expert has claimed.
The Duke of Sussex is currently involved in a bitter court battle over his visa application, after conservative think tank Heritage Foundation called his immigration status into question after he admitted in his explosive memoir Spare that he had taken cocaine, mushrooms and smoked marijuana. Harry and Meghan Markle moved to the US in 2020, and his book was published three years later, prompting criticism from the Heritage Foundation, who accused the US government of favouring the prince and approving his visa.
Under US law, anyone who has taken drugs, or labelled as a “drug abuser” is in danger of being deemed “inadmissible” to America, and their strict laws have prevented other famous faces, such as Nigella Lawson and Stranger Things star Charlie Heaton, from entering the United States. The Heritage Foundation took their complaint to court, and is seeking the release of Harry’s visa application in an effort to know if he lied about his previous drug use, or if he had been given special treatment by the Department of Homeland Security.

Pressure is now growing on President Biden’s government after comments from the American ambassador to London, who claimed the Duke of Sussex would not be deported from the US while the Democratic president was in the White House. Ambassador Jane Hartley was asked about the possibility of Harry being deported during an interview with Sky News, and her subsequent remarks have been pounced upon by the Heritage Foundation.
“Well it’s not going to happen in the Biden administration,” she said. President Biden is up against Donald Trump in the US election which is set to take place later this year, and the former president has already spoken out about deporting Harry if he was found to have lied in his visa application, or been given special treatment.
A spokesperson for the Heritage Foundation said the ambassador’s comments on Harry’s case were “extraordinary”, and claimed the White House had “categorically stated” they would not deport the Duke of Sussex, whatever the outcome of the court case. “Ambassador Hartley categorically stated that the Duke of Sussex will not be deported by the Biden Administration,” they said. “Thus, the Executive Branch has now categorically stated that, regardless of future circumstances, they will decline to deport the Duke of Sussex – even in the most extreme of cases.”
Judge Carl Nichols, who is presiding over the case, has yet to make a ruling, but the Biden administration has argued against the visa application being released over privacy claims. While previous drug use does not automatically ban a person from entering the US, they are legally obliged to declare past drug use on their visa application.
