A West London man forced a woman’s legs apart, raped her as she cried, then slammed her for ‘laying still like a sex doll’, a court has heard. Wayne Mundy, 52, was jailed for nine years at Wood Green Crown Court on Wednesday (August 27) after he was found guilty of raping the same woman three times.

Mundy, who has no previous convictions, was cleared on two counts and another will lie on the file. The trial heard Mundy raped the victim, who cannot be identified for legal reasons, twice while she was asleep, and another time despite her clear refusals. The victim wrote a seven-page victim impact statement, but its contents were not read in open court.

Each count was aggravated by the fact Mundy ejaculated, and because the victim was clearly vulnerable due to her being asleep, or, in the case of Count 6, having previously been subject to sexual violence by virtue of convictions for Counts 1 and 3.

Defending Mundy, Emily Culverhouse said, after having time to think in prison, her client had shown more remorse than during the trial. “Mr Mundy is extremely sorry for his actions,” said Ms Culverhouse.

Referring to Counts 1 and 3, Judge Daniel Fugallo told Mundy he had been convicted of penetrating the woman’s vagina while she was asleep, and unable to consent. “She woke up to find herself being penetrated by you. She had made it abundantly clear to you she did not want to be penetrated in that way,” added the judge.

The judge said the woman was ‘asleep, unaware of what was going on, unable to choose, unable to say no’. In relation to Count 6, Judge Fugallo said Mundy had told the woman he wanted to orgasm, but she made it clear she did not want sex.

“You did not accept that. You wanted sex and you wanted to orgasm,” said the judge, then describing the rape which involved forcing the woman’s legs open as she cried. “After that, you criticised her for laying there ‘like a sex doll’ as you raped her,” added the judge.

Judge Fugallo told Mundy his best mitigation was his previous good character, and the support of his family and good record of staying in work.

Mundy will serve nine years for Count 6, and seven years concurrent each for Counts 1 and 3. He is now entered onto the sex offenders register so must notify police of his whereabouts.
